ГЛОБАЛЬНЫЙ ИЗРАИЛЬСКИЙ ТЕРРОРИЗМ   СПЕЦИАЛЬНЫЕ ПРИЛОЖЕНИЯ  приложение третье  ДРУГИЕ ДОПОЛНЕНИЯ - 2   UN HIMAN RIGHTS COMMITTEE     КОМИТЕТ ПО ПРАВАМ ЧЕЛОВЕКА   ОРГАНИЗАЦИИ ОБЪЕДИНЕННЫХ НАЦИЙ     Израиль: 1) В этом документе Комитет Прав Человека ООН выражает глубочайшее беспокойство относительно основных израильских законов: они не соответствуют международным (ООН и другим) стандартам и находятся в противоречии с демократическими ринципами.    1) In that document UN Human Rights Committee expresses deep concern about      Israeli basic laws they do not match international (UN and other) standards and      are in contradiction with democratic principles   2) Комитет Прав Человека ООН выражает беспокойство по поводу положения женщин, дискриминация которых во многих аспектах жизни, включая военную службу и религиозные учреждения, продолжается, и которые не имеют адекватного представительства в общественных делах (в Израиле).  2) The UN Human Rights Committee expresses concern over the situation of      women who continue to face discrimination in many aspects of life, including      in military service and in religious institutions, and that they are      underrepresented in the conduct of public affairs.   3) Комитет выражает сожаление по поводу того, что женщины, которых доставляют в Израиль с целью проституции (многих - под ложными предлогами или через принуждение), не защищены как жертвы работорговли, но - наоборот - как правило подвергаются наказанию за их незаконное присутствие в Израиле. Такой подход к этой проблеме эффективно мешает этим женщинам искать защиты от нарушения их прав согласно статье 8 Конвенции. Комитет настаивает (рекомендует), чтобы были предприняты серьезные усилия для розыска и наказания работорговцев, чтобы были созданы реабилитационные программы для жертв, и чтобы им были предоставлены гарантии, что они имеют право (в Израиле) возбуждить юридический иск против преступников. 3) The Committee regrets that women brought to Israel for purposes of     prostitution, many under false pretences or through coercion, are not     protected as victims of trafficking but are likely to be penalized for their     illegal presence in Israel. Such an approach to this problem effectively     prevents these women from pursuing a remedy for the violation of their     rights under article 8 of the Covenant. The Committee recommends that     serious efforts be made to seek out and punish the traffickers, to institute     rehabilitation programmes for the victims and to ensure that they are able     to pursue legal remedies against the perpetrators.     4) Комитет выражает глубокое беспокойство относительно закона Levi - Landau, который юридически разрешает пытки в   Израиле.  4) The Committee express a deep concern about the Levy-Landau law,      which legally allows tortures in Israel.   5) Комитет сожалеет по поводу того, что власти по-видимому создают искусственные препятствия на пути воссоединения семей в случаях браков между гражданами Израиля и не гражданами не еврейского происхождения (у которых поэтому нет право на въезд в Израиль по Закону Возвращения). Эти препятствия, которые включают в себя период длительного ожидания разрешения на въезд, "испытательный" период на срок более, чем пять лет жительства в стране - чтобы устанавливать, подлинный ли это брак, - и - далее - период ожидания гражданства. 5) The Committee regrets that the authorities appear to be placing obstacles      in the way of family reunion in the case of marriages between an Israeli      citizen and a non-citizen who is not Jewish (and therefore not entitled to      enter under the Law of Return). These obstacles, which include long      waiting periods for entry permits, a "probation" period of over five years'      residence to establish that the marriage is genuine and a further waiting      period for citizenship   6) Комитет обеспокоен привилегиями (предпочтением), даваемыми еврейской религии в ассигновании  финансирования религиозных органов, в ущерб мусульманам, христианам, друзам и другим религиозным группам. Комитет рекомендует, чтобы инструкции и критерии для финансирования были опубликованы (обнародаваны) и применитесь к всем религиозным группам на равном основании.   6) The Committee is concerned at the preference given to the Jewish        religion in the allocation of funding for religious bodies, to the detriment       of Muslims, Christians, Druze and other religious groups. The Committee       recommends that regulations and criteria for funding be published and       applied to all religious groups on an equal basis.   7) Комитет обеспокоен тем, что применение религиозного закона для определения вопросов персонального статуса, включая брак и развод, и отсутствие законодательства о гражданском браке фактически отрицает право некоторых людей вступать в брак в Израиле, а также приводит к неравенству между мужчинами и женщинами. Комитет также обеспокоен тем, что минимальный возраст брака для девушек, установленный в соответствии с законом в 17 лет, может быть уменьшен религиозным судом, и что никакой минимальный возраст вообще не установлен для мальчиков.  Отсутствие законов о гражданских похоронах - также вопрос, вызывающий беспокойство. Комитет торопит как можно более скорое выполнение мер, рассматриваемых в настоящее время, для облегчения гражданских браков и гражданских похорон для тех, кто не принадлежат религии. Мы рекомендуем, чтобы государство (Израиль) приняло во внимание международные стандарты (......).   7) The Committee is concerned that the application of religious law to determine matters of personal   status, including marriage and divorce, and the absence of provision for civil marriage effectively deny   some persons the right to marry in Israel, and result in inequality between men and women. It is also   concerned that the minimum age of marriage for girls, fixed by law at 17, may be reduced by the religious   courts, and that no minimum age is fixed for men. The lack of provision for civil burial is also a matter of   concern. The Committee urges early implementation of measures currently under consideration to facilitate   civil marriages and civil burial for those who do not belong to a religion.
