I am pondering over a draft of my application to the Council of Ministers of the Russian Federation.
This is a responsible thing to do! It is not often that an ordinary citizen appeals to the Government.
Perhaps I have taken a similar step only once before - during my post-graduate studies, when I informed the Government of the USSR (or to the State Committee?) about the results of my dissertation research on the economic evaluation of natural resources... (The answer was a kind of something favorable. Something like: "the results of your research will be taken into account in practical activities"...).
For all my life, up to this moment, I had only one application to the Government (or to the State Committee of the USSR?). I try to choose the most optimal way of action...
In the process of today's reflection a simple thought occurs to me.
The system of tax and financial authorities - thanks to my statements - is no worse acquainted with the situation than I am.
Moreover, they have at their disposal information about the actions in the Unified State Register of Real Estate (UGRN). This is information which is not in my possession but which I can guess from the answers I received.
None of the answers I received from tax authorities disputed my concern about the danger of (а) underpayment of tax and (b) "disappearance" of the property object from the "tax base". From this I can assume that, indirectly, the tax authorities agree with my argumentation.
The main difficulty, as I can surmise from the answers I received, is that the maintenance of UGRN is in the competence of another government body. Tax, financial authorities, may be, happy to take immediate and effective measures to protect the tax interests of the state - but how can they do this, if the maintenance of the UGRN is not in their competence? (So it turns out that the issue and protection of tax interests of the state - in this situation - should engage me - a simple taxpayer, not them).
Added to this are such important circumstances: tax, financial authorities, unlike me, have (a) exclusive professional information, (b) have a computer databases with up-to-date legal information, (c) have numerous employees who specialize in matters of law enforcement, (d) are funded from the state budget, (e) are vested with state power.
So here's the thought that comes to me: it would be much more productive if the Council of Ministers were approached not by me, a mere taxpayer (I am not in public service, and not specialized in tax, financial matters), but by the tax, financial authorities.
If to summarize my thoughts, it turns out that the tax and financial authorities have a number of advantages before me:
First, they have a lot more information (compared to me) - including about actions in the UGRN. At the same time they do not challenge my arguments about the danger for the state of such phenomena as underpayment of taxes and "disappearance" of the object of taxation from the "tax base".
Secondly, they have the power, the state funding, teams of legal experts, fresh computer legal bases.
So who can appeal to the Government with the most efficiency?
I have already appealed to both the Interdistrict Inspectorate, and the Office of the Federal Tax Service of Russia in the Rostov region, and the Federal Tax Service of the Russian Federation (FTS RF), and the Ministry of Finance of the Russian Federation (Ministry of Finance RF).
If I have already reached the level of the Ministry of Finance RF, I should probably ask the employees of the Ministry of Finance to apply to the Council of Ministers of the RF for protection of tax interests of the state.
Such an appeal eliminates the difficulty that the UGRN is not in the competence of the RF Ministry of Finance (and the Federal Tax Service).
The Council of Ministers of the RF is "above" the tax authorities, the Ministry of Finance of the RF, the state registrars (a maintaining of USRN), the Department of Real Estate, the Ministry of Economic Development of the RF. Consequently, what is perhaps a difficulty for the tax and financial authorities - "the independence of the UGRN" - this factor will not cause any difficulty for the higher body - the Council of Ministers.
And it is obvious that the appeal to the Council of Ministers of the tax, financial authorities will be no less correct document than my personal statement to the Government of the Russian Federation. (Collective intelligence, special professional competence, fresh legal computer bases...).
So, my goals and my plan must apparently undergo a change.
I must first of all reflect not on the draft of my statement to the RF Council of Ministers, but on the text of my request to the RF Ministry of Finance to send a memo (or other document) to the Government on the need to protect the tax interests of the state.
That the employees of the Council of Ministers of the Russian Federation will take measures to protect the tax interests of the state in the fastest and most effective way (as soon as they will receive the alarming information about dangerous tax events) - in this I have not the slightest doubt.
Thus, apparently, I need to work on drafting my appeal to the RF Ministry of Finance.
